If I resign a job with enough vacation to last until next year, can I get paid for vacation next year also?

I have about 3 weeks of vacation time left at my current job. I am planning to resign such that December 12, 2008 is my last day, and take vacation until the end of the year. Obviously I will get paid until December 31, 2008. But since I have some leftover days, could I technically be considered an employee on January 1, 2009, at which point I could take my 3 weeks of vacation time for 2009, and get paid for those extra 3 weeks?

I assume it depends on the company and I will have to ask payroll, but is it typical to allow that?

I’m a single male in my 20’s, I’m working my first real job and I have two weeks of vacation time which I’d like to use sometime during the summer. Unfortunately, all my friends are busy or are unemployed and too poor to go anywhere or do anything. I want to go someplace new and exotic, but if I do, I’ll be going alone. Where should I go and what should I do?

Can a previous employer collect an overpayment of vacation hours 6 months after leaving the company?

My husband and I took a 3 week vacation this past summer. Prior to leaving on our trip he sent in his letter of resignation, upon our return he would be accepting another job at a different company. His last paycheck from his previous employer was basically ALL his vacation pay…
So, NOW, 6 months later he just received an email informing him that they, by mistake, made an overpayment of vacation hours and they are asking us to repay a fairly large sum of money. Do they have any legal recourse?
